TERMS AND CONDITIONS
1. INTERPRETATION
In these terms and conditions:
"L & L" "we" or "us" means Leaves and Lifestyles.
"You" means the person ordering the goods from us.
2. APPLICATION OF TERMS
Your use of and purchase of goods from this site is governed by these terms and conditions.
We may at any time makes changes to this site and the details displayed on it.
3. AVAILABILITY
All items are subject to availability. We will inform you as soon as possible if the goods you have ordered are not available.
We reserve the right to substitute goods of equal quality and value. We will reimburse you for the cost of returning substitute goods that you do not wish to accept.
4. PRICES AND PAYMENT
The prices for goods displayed for sale on this site are inclusive of VAT. Delivery will be charged in addition and any additional charges are displayed where they apply. Prices and delivery charges are effective only in the United Kingdom.
We cannot accept your order until you have paid for it in full (including applicable delivery charges). Upon payment we will confirm acceptance of your order by email which will be sent to the email address you provide on your order details.
5. DELIVERY
There is only one delivery charge per order which is included in the price of the item and is available to addresses within mainland England, Wales & Scotland (with the exception of the Highland & Grampian postcodes outline on the delivery pages). All other areas will be by quotation.
Delivery normally occurs between [8am and 5pm]. The exact timing of delivery cannot be specified. Unless otherwise stated, all deliveries will be made direct to your door. If you are not at home when your goods are delivered they can, by prearrangement only, be left in a safe place that is specified by you. This will only be done at your risk. On smaller items the carrier will leave a card with instructions on how to reschedule the delivery at a convenient time.
6. CANCELLATION
You have the legal right to cancel your order within 7 working days of receipt of the goods.
You may cancel your order (or any part of it) for any reason before delivery or within 7 working days after delivery by calling us on 0845 601 9983 or emailing us at sales@leavesandlifestyles.co.uk to cancel the order (or part of it) and arrange collection. This is subject to the following conditions:
the goods must be unused, as new, returned in the original packaging and in a resaleable condition
orders which are made to measure, cut or mixed to your requirements cannot be exchanged or refunded (unless they are faulty)
you will receive a full refund of the price paid less any collection charges.
7. FAULTY PRODUCTS
If the goods you purchase are faulty, we may offer a repair, exchange or refund as appropriate in accordance with your legal rights.
8. GENERAL CONDITIONS
We shall not be liable to you where performance of any of our obligations to you is prevented or impeded by reason of acts of God, governmental actions, war or national emergency, acts of terrorism, civil commotion, fire, explosion, flood, lock-outs, epidemic, strikes or other labour disputes or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials or any other cause not within our reasonable control.
If any part of these terms and conditions is found to be unenforceable as a matter of law, all other parts of these terms and conditions shall not be affected and they shall remain in force.
We cannot guarantee that the colours and/or appearance of goods shown on this site exactly reproduce the colours and/or appearance of the goods themselves. Natural products may show some colour variations. The weights, dimensions and capacities given are approximate only.
As soon as the goods have been delivered you will be responsible for their safekeeping and Leaves & Lifestyles will not be responsible for any damage or fault arising from incorrect storage.
Ownership of the goods shall not pass to you until Leaves & Lifestyles has been paid in full for them and all other sums due to Leaves & Lifestyles from you have been paid in full.
To the extent permitted by law, Leaves & Lifestyles disclaims all warranties, express or implied, as to the accuracy of the information contained in any of the materials on this website. Leaves and Lifestyles is a trading name of M & M Timber Ltd. Leaves & Lifestyles shall not be liable to any person for any loss or damage which may arise from the use of any of the information contained in any of the materials on this website.
Any disclaimers and exclusions of liability in these terms and conditions shall not apply to any damages arising from death or personal injury caused by the negligence of Leaves & Lifestyles or any of its employees or agents or fraud.
These terms and conditions and any contract between us shall be governed by and construed in accordance with English Law and the English courts shall have jurisdiction over any disputes between us. All contracts are concluded in English.
